1. About these terms

These terms of service ("Terms") are a legal agreement between you ("you", "your", "the customer") and freewebsites.co.uk, operated by a company registered in England and Wales (Company No. 11499301) ("we", "us", "our").

By creating an account or using our services at freewebsites.co.uk, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Our services

We provide:

  • Website design and build for UK small businesses
  • Website hosting on secure infrastructure in the EU or the United Kingdom
  • Domain name registration and management (via third-party registrars)
  • Website editing tools
  • Optional add-on services such as additional pages, printed marketing materials, and security monitoring

The initial website design is provided at no charge. Ongoing hosting and any add-on services are subject to the fees described in section 5.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement. If you are signing up on behalf of a business, you confirm that you have authority to bind that business to these Terms.

4. Your account

You are responsible for keeping your login credentials secure. You must not share your account with others. You are responsible for all activity that occurs under your account.

You must provide accurate and complete information when creating your account and keep it up to date. We may suspend or terminate accounts that contain false or misleading information.

5. Pricing and payment

5.1 Free trial

New accounts include a free trial period. During the trial, you can use our website builder and preview your site. The length of the trial period is displayed at sign-up.

5.2 Hosting subscription

After your trial ends, a monthly hosting subscription is required to keep your website live. The current price is displayed on our pricing page. We may change our prices with at least 30 days' written notice to you by email.

5.3 Add-on services

Add-on services (such as extra pages, printed materials, or security monitoring) are charged at the prices displayed at the time of purchase. One-off purchases are non-refundable once the work has been delivered or the order has been sent to print.

5.4 Domain names

Domain registration fees are charged at the time of purchase. Domain fees are non-refundable as registration is processed immediately with our registrar. Domains are registered for a minimum period of one year and will need to be renewed to remain active.

5.5 Payment method

All payments are processed securely by Stripe. By providing a payment method, you authorise us to charge recurring subscription fees automatically. You can cancel your subscription at any time (see section 8).

5.6 Failed payments

If a payment fails, we will attempt to collect it again. If payment remains outstanding, we may suspend your website until the balance is settled. Websites suspended for more than 30 days due to non-payment may be permanently removed.

6. Your website content

6.1 Ownership

You own the content you provide to us (business information, logos, text, images you upload). You grant us a licence to use this content solely for the purpose of building, hosting, and displaying your website.

6.2 Stock imagery

Where we use stock photography from third-party providers (such as Pexels) on your website, those images are used under their respective licences. You may not extract and resell stock images separately from your website.

6.3 Prohibited content

You must not use our services to publish content that:

  • Is unlawful, threatening, abusive, defamatory, or fraudulent
  • Infringes any third party's intellectual property rights
  • Contains malware, phishing attempts, or malicious code
  • Promotes illegal activities or violence
  • Is pornographic or sexually explicit
  • Violates any applicable UK law or regulation

We reserve the right to remove any content that breaches these rules and to suspend or terminate your account without refund.

7. Contact form submissions

Your published website may include a contact form that allows visitors to send you messages. We store these submissions on your behalf and forward them to you. You are responsible for how you use the personal data submitted through your contact form, including compliance with UK GDPR. We provide a privacy policy for your website visitors at /privacy/websites which you may link to from your site.

8. Cancellation

8.1 By you

You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. Your website will remain live until the end of the paid period, after which it will be taken offline.

8.2 By us

We may terminate or suspend your account if you breach these Terms, fail to pay, or use our services for prohibited purposes. Where reasonably possible, we will give you notice and an opportunity to remedy the breach before termination.

8.3 After cancellation

After cancellation, your website will no longer be publicly accessible. We will retain your account data for a reasonable period in case you wish to reactivate, after which it will be deleted in accordance with our Privacy Policy.

9. Availability and support

We aim to keep your website available 24/7 but do not guarantee 100% uptime. Occasional downtime may occur for maintenance, updates, or circumstances beyond our control. We are not liable for any losses caused by temporary unavailability of your website.

10. Intellectual property

All rights in our platform, tools, templates, and code remain with us. These Terms do not transfer any intellectual property rights to you, other than a licence to use the service while your account is active.

The HTML, CSS, and design of your generated website is licensed to you for use on our hosting platform. If you cancel, you may request a copy of your website's source code for personal archival purposes.

11. Limitation of liability

To the fullest extent permitted by law:

  • Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total fees you have paid to us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, business, or goodwill.
  • We are not liable for any losses caused by third-party services (Stripe, domain registrars, stock photo providers) or by content you publish on your website.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

12. Indemnity

You agree to indemnify and hold us harmless against any claims, losses, or expenses (including legal fees) arising from your breach of these Terms or your use of our services, including any content you publish on your website.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before they take effect. Your continued use of our services after the changes take effect constitutes acceptance. If you do not agree to the updated Terms, you may cancel your account.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under UK law.
